These Terms of Service ("Terms") govern your use of mypracticegroup.com (the "Site") and the digital marketing services provided by myPracticeGroup ("we," "us" or "our"). By using the Site, you agree to these Terms.
1. Services
We provide digital marketing services to healthcare practices, including website and SEO, reputation management, social media marketing, digital advertising and Google Business Profile optimization. The scope, fees and timing of any engagement will be set out in a written proposal, statement of work or service agreement ("Agreement"). If an Agreement conflicts with these Terms, the Agreement controls for that engagement.
2. Use of the Site
You agree to use the Site lawfully and not to interfere with its operation, attempt unauthorized access, submit false or harmful content, or use it to send unsolicited messages. Please do not submit protected health information or patient details through the Site.
3. No guarantee of results
Search rankings, advertising performance, reviews and social engagement depend on many factors outside our control, including search engine and platform algorithms and policies. We do not guarantee any particular ranking, traffic, lead volume or revenue.
4. Client responsibilities
Clients are responsible for providing accurate information and timely approvals, for the accuracy of claims about their services, and for compliance with laws and professional rules that apply to their practice, including advertising, licensing and patient privacy requirements. We are a marketing provider and do not provide legal, medical or compliance advice.
5. Fees and payment
Fees are described in the applicable Agreement. Third-party costs such as advertising spend, software or stock content are separate unless otherwise stated. Unless an Agreement says otherwise, our services are month-to-month and may be cancelled by either party with written notice.
6. Accounts and access
Where possible, accounts such as domains, advertising accounts and business profiles are held in the client's name. Clients are responsible for the credentials they share with us and for notifying us if access should change.
7. Intellectual property
The Site, including its text, graphics, logos and code, is owned by or licensed to myPracticeGroup and protected by intellectual property laws. Ownership of deliverables created for a client is governed by the applicable Agreement. Clients grant us permission to use the materials they provide to perform the services.
8. Confidentiality
Each party will use reasonable care to protect the other's non-public business information and use it only for the engagement, except where disclosure is required by law.
9. Third-party services
Our services may rely on third-party platforms and tools. We are not responsible for their availability, changes, policies or actions, including account suspensions.
10. Disclaimer of warranties
The Site and content are provided "as is" and "as available." To the fullest extent permitted by law, we disclaim all warranties, express or implied, including merchantability, fitness for a particular purpose and non-infringement.
11. Limitation of liability
To the fullest extent permitted by law, myPracticeGroup will not be liable for indirect, incidental, special, consequential or punitive damages, or for lost profits or revenue, arising from the Site or our services. Our total liability for any claim is limited to the fees paid to us for the services giving rise to the claim in the three months before the claim arose, unless an Agreement states otherwise.
12. Indemnification
Clients agree to indemnify us against third-party claims arising from materials, claims or instructions they provide, or from their breach of these Terms or applicable law.
13. Termination
We may suspend or end access to the Site or services if these Terms are violated. Provisions that by their nature should survive termination will survive.
14. Governing law
These Terms are governed by the laws of the State of North Carolina, without regard to conflict-of-law rules. Disputes will be resolved in the state or federal courts located in North Carolina, unless an Agreement states otherwise.
15. Changes
We may update these Terms from time to time. Continued use of the Site after changes means you accept the updated Terms.
